Its definately a cripplefight so far 1 team who have no ball want to play, another team who have loads of ball refusing to.

Yeah. That was never a pen. But Gardener has made it clear what he sees as acceptable so both sides need to adhere to that.
He gave Ritchie a far worse one earlier though.
